Road traffic accident FAQs

Can I claim if the accident wasn't my fault?

Yes. If you were the non-fault driver, passenger, motorcyclist, cyclist or pedestrian, you can claim compensation for injuries, vehicle damage, loss of earnings, medical costs and travel expenses.

How much is a whiplash claim worth in the UK?

Since the 2021 Whiplash Reform, fixed tariffs apply for injuries lasting up to 2 years — typically £240 to £4,345. Severe or longer-lasting injuries are valued outside the tariff and can be worth significantly more.

What is the time limit for a road traffic accident claim?

You have 3 years from the date of the accident (or from the date you became aware of the injury) to bring a personal injury claim in the UK. For children, the 3 years runs from their 18th birthday.

Can I claim if the other driver was uninsured or fled the scene?

Yes. The Motor Insurers' Bureau (MIB) compensates victims of uninsured and untraced (hit-and-run) drivers. Our panel solicitors handle MIB claims regularly.

Will I get a replacement vehicle while mine is repaired?

Usually yes. As a non-fault driver, you're entitled to a like-for-like hire vehicle while yours is being repaired or written off, at no upfront cost to you.

Do you cover motorbike, cycling and pedestrian accidents?

Yes. Our panel handles all road traffic accident types — cars, motorbikes, lorries, cyclists, e-scooter riders and pedestrians hit by a vehicle anywhere in the UK.
